These Terms & Conditions govern your use of the website at wellnesselitefitness.com, the SMS messaging program operated by Wellness Elite Fitness, LLC, and the membership and consultation services offered by the practice. By using this site, opting in to messaging, or becoming a member, you agree to these terms.

The SMS program.

Program description

Wellness Elite Fitness operates an opt-in SMS messaging program for transactional and marketing communications, including appointment reminders, member updates, billing notices, class scheduling, and occasional promotional offers. The program is operated by Wellness Elite Fitness, LLC under the brand “Wellness Elite Fitness” (also abbreviated “WEF”).

Express written consent

By providing a mobile number to Wellness Elite Fitness through any form on this site, in person at the facility, or by replying to a message, you provide express written consent to receive SMS messages from Wellness Elite Fitness. Consent is not a condition of purchase.

Message frequency

Message frequency varies. Members typically receive 4–8 messages per month; prospects who opt in for offers typically receive 1–3 messages per month. Frequency may temporarily increase during a member’s first onboarding week.

Fees

Message and data rates may apply based on your mobile carrier’s plan. Wellness Elite Fitness does not charge any per-message fee.

Opt-out and help

Reply STOP to any message to unsubscribe from all SMS messaging. After replying STOP you will receive a single confirmation message, after which no further messages will be sent.

Carrier disclosure

Carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon, U.S. Cellular, and most regional carriers. Some message types may be unavailable on certain carriers.

Mobile information privacy

We will never sell or share your mobile information for marketing or promotional purposes with third parties or affiliates. Mobile information is used only to deliver the messages described above, and is shared only with subprocessors (such as Twilio and Klaviyo) strictly for the purpose of delivering those messages on behalf of Wellness Elite Fitness. Use of the website.

The website and its content are owned by Wellness Elite Fitness, LLC and are protected by copyright, trademark, and other laws. Editorial content from The Bioneer is additionally protected; see thebioneermag.com for that publication’s terms.
You may view and download materials for personal, non-commercial use only.
You agree not to scrape, mirror, frame, reverse-engineer, or redistribute site content without written permission.
AI/LLM crawling and inference are permitted subject to the terms in our ai.txt.

Membership services.

Membership at Wellness Elite Fitness is governed by the separate Membership Agreement signed at enrollment. Membership tiers, pricing, and benefits are described at consultation. By using membership-only services, you agree to the Membership Agreement and to applicable facility rules.

Memberships are by appointment for new applicants; the practice prefers to walk new members through the floor before they commit.
Group memberships of three or more receive 15% off all tiers.
The free day pass is offered for facility-floor access (strength floor + cardio bay). Recovery modalities (HBOT, cryotherapy, sauna, IV, float, PEMF, etc.) are reserved for members.

Editorial & medical disclaimer.

Wellness Elite Fitness is a wellness facility, not a medical provider. Editorial content on this site, in The Bioneer publication, and from our team is informational only and is not medical advice. Consult your physician before beginning any new protocol. Members interested in physician-supervised medical services are referred to the adjacent practice Elite Aesthetic MD, which is a separate medical entity owned and operated by Dr. Swet Chaudhari, MD.

Limitation of liability.

To the fullest extent permitted by law, Wellness Elite Fitness, LLC, its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site, the SMS program, or the facility. The practice’s aggregate liability is limited to the fees paid by you in the twelve months preceding the claim.

Governing law.

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Galveston County, Texas.

Changes.

We may update these Terms from time to time. The “Effective” date at the top of this page reflects the most recent version. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
